1. Agreement to Terms

By accessing or using ThemeParkQuiz.com ("Service"), owned and operated by Premier Code, Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

ThemeParkQuiz.com is an online trivia platform focused on theme parks, roller coasters, and attractions. Our Service allows users to:

  • Play trivia quizzes about theme parks
  • Track scores and progress
  • Compete on leaderboards
  • Access premium features through paid subscriptions

3. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any portion of the Service
  • Use any automated means to access the Service
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity
  • Share your account credentials with others
  • Cheat or manipulate quiz results
  • Harass, abuse, or harm other users

5. Subscriptions and Payments

Free and Paid Features: Some features of the Service are available for free, while others require a paid subscription.

Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually). Payment is processed through Stripe.

Cancellation: You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

Refunds: Refunds are provided at our sole discretion. Contact us within 7 days of purchase if you believe you are entitled to a refund.

Price Changes: We reserve the right to modify pricing. Existing subscribers will be notified of any price changes before their next billing cycle.

6. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by Premier Code, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Theme park names, logos, and related marks referenced in our quizzes are trademarks of their respective owners. We are not affiliated with, endorsed by, or sponsored by any theme park company unless explicitly stated.

7. User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

You represent that you own or have the necessary rights to submit such content and that it does not violate any third-party rights.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREMIER CODE, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless Premier Code, Inc. and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Texas.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms.
